Strata Owners enjot quality lifestyle

Strata titled living, whereby individuals each own a portion of a building and share ownership of common areas is becoming widespread. And Strata owners are enjoying a new rise in status as others come to see the lifestyle they enjoy as being upheld by-law.

But what are by-laws and what do they cover? By-laws are the heart of strata title living. And they are not the bugbear of times past. Once thought of as constraints on good living they are today the hallmark of a way of life that has well and truly become modern.

Mr Richard Tooker, the Director of New South Wales Strata Management, says the roll of today’s model bylaws provides an excellent glimpse into the range of issues that a strata scheme may adopt.

“They relate not only to safety and security measures but also to ensuring a high quality of life.”

Mr Tooker says that under the Strata Schemes Management Regulation 2005 such issues as noise, the keeping of animals, obstruction of common property, and the behaviour of owners, occupiers and invitees can assist in maintaining a level of social accord and amity that can be the envy of some communities of non-strata or stand-alone dwellings.

“A reading of the model by-laws about noise, for example, is an enviable model of common sense which simply states that people should not create noise that is likely to disturb the peaceful enjoyment of another resident or anyone using common property.”

New South Wales Strata Management, he says, controls hundreds of strata title properties, playing significant oversight roles in helping owners’ corporations comply with their strata title responsibilities.

“An owner’s corporation may add to or alter a by-law to assist the operation of the strata scheme by passing a special resolution at a general meeting. And the buy-laws are registered with the Lands Department, noted on the common property title deed.”

The objective of the by-laws is to allow flexibility whilst enabling the buildings’ owners to have a rightful say in how the micro-community lives its day to day life.

“As one looks around one doesn’t have to look far to find a street or neighbourhood where the local people would love to have control back over how they live. For many such people it’s just one of the factors that make strata titled living look increasingly smart.”
